Privacy Policy

The present charter on the respect of privacy (the "Charter") aims to formalise our commitment to the respect of the privacy of users of the websites https://www.kestio.com/ethttps://kestio.live/ operated by SAS KESTIO.

Personal data means any information that directly or indirectly identifies a natural person ("Personal Data"). We collect and process Personal Data for the purpose of providing our Services or communicating about these Services only, in strict compliance with the French Data Protection Act. The data collected is essential for this processing. You will never be asked to provide so-called "sensitive" personal data, such as your racial or ethnic origins, your political, philosophical or religious opinions.

By registering on the Website, you authorise us to process your Personal Data in accordance with the Policy. If you do not agree to the terms of this Policy, we ask that you do not use this Website or our Services.

When do we collect your Personal Information?

We may collect and retain your Personal Information, including when you :

  • create a customer account or user profile
  • create a Document
  • pay for a service
  • subscribe to our newsletter

1.1 Browsing the Site

Connection Data. Each time you connect to our Site, we passively collect information such as, but not limited to, your computer's IP address and MAC address, date and time of connection, and browser information.

Navigational data. We also collect information that identifies how you access the Site, which pages you visit and for how long. We may make use of Cookies as set out in paragraph 6 below.

1.2 Creating a Customer Account or User Profile

Some Services require the prior creation of an Account. In accordance with the General Terms of Use, you will be asked to provide a certain amount of Personal Information when creating your Account, in particular your first and last names, your postal address, your e-mail address and your telephone number.

When creating a personalised profile on the Site, each user communicates his or her surname, first name, address, email and telephone number.

1.3 Payment

Some of the Services available on the Site are chargeable. To this end, you agree that we may use external service providers who will collect your Personal Data in order to enable the proper functioning of the services for processing credit card payments, SEPA direct debits and, where applicable, product delivery.

To pay for your purchase, you must provide :

  • For a payment by credit card: Your billing details as well as your payment details, i.e. your payment card number, the name of the cardholder, the validity date and the security codes, in order to process your recurring or non-recurring payments.
  • For a payment by SEPA direct debit: Your billing details as well as your bank details, i.e. IBAN, BIC, name of the bank account holder, and name of the banking organisation, in order to process your recurring or non-recurring payments.

We keep details of your payments, as well as details of the purchases you make. Transaction details are stored either at WooCommerce and our banking institution for SEPA payments and at STRIPE for CB payments, or at external service providers. This storage is done for internal purposes, including accounting, compliance and legal purposes, in accordance with paragraph 5 of this Charter.

1.4 Joining our Newsletter

When creating your Account, you may give your consent to receive newsletters about new products, services and promotions as part of the Services.

1.5 Contacts

In order to respond to requests you may make to our Customer Service Department, to confirm information and any transactions in your Account and to provide you with information regarding the Services (for example, if you lose your password or if changes are made to the Terms of Use), we will use your first and last name and email address.

How do we protect your Personal Information?

We have implemented technical and organisational security measures to guarantee the security, integrity and confidentiality of all your Personal Data, in order to prevent it from being distorted, damaged or accessed by unauthorised third parties. We ensure a level of security appropriate to the risks associated with the processing and the nature of the data to be protected, taking into account the level of technology and the cost of implementation.

However, no method of data transmission over the Internet or electronic storage can guarantee 100% security. As a result, we are unfortunately unable to guarantee absolute security for your Personal Data.

Furthermore, you are responsible for maintaining the confidentiality of the password that allows you to access your Account. Do not share this information with anyone. If you share your computer, remember to log out before leaving a Service.

How do we use your Personal Information?

We use your Personal Information to enable the implementation and management of the Site Services and to respond to your specific requests. We also use your Personal Information to operate and improve our Services, our Site and our approach. This information is used solely by us and allows us to better tailor our Services to your needs. In particular, when you use the questionnaires, we reserve the right to collect, collate and record some of your data, e.g. your response times, your default choices, etc.

With regard to Users, we use Personal Data exclusively for the creation of individual profiles published on the Site and for the Matchmaking service.

If you have opted-in to receive emails and mini-messages from us when you create your Account, then you will receive email and alpha-numeric messages about our products and promotions. We will then use the Personal Information you provided when you registered. You can unsubscribe from these mailings at any time.

When do we share your Personal Information?

We undertake not to disclose your Personal Data to any third party without obtaining your express prior consent.

4.1 Sharing your Personal Data with third parties

When you browse the Site, your Personal Information may be transmitted to external service providers. These third parties provide a service on our behalf to enable the smooth operation of credit card payments and other Services. They may be hosted in countries outside the European Union for security purposes.

In accordance with the legislation, all transfers of Personal Data to a country outside the European Union and/or not offering a sufficient level of protection with regard to French legislation have been subject to cross-border flow agreements in accordance with the European Commission's standard contractual clauses and declared to the CNIL. Unless a third party asks you to agree to its own privacy policy and terms of use, third party companies that receive your Personal Information will only share it with us.

We will never, without your prior consent, share Personal Data with third party companies for marketing and/or commercial purposes.

4.2 Sharing with authorities

We may disclose Personal Data to administrative or judicial authorities when disclosure is necessary for the identification, arrest or prosecution of any individual who may be infringing our rights, or of any other user or third party. We may also be legally required to disclose Personal Information and cannot object to such disclosure.

How long do we keep your Personal Data?

We will only keep your Personal Data for the time of your registration on the Site in order to ensure your identification when you log in to your Account and to allow the provision of the Services. Except where laws and regulations require a different retention period, we will retain your Personal Information for as long as is strictly necessary for the purposes set out in this Policy.

If you unsubscribe from the Site, your Personal Data will be deleted and only kept as an archive for the purpose of establishing proof of a right or a contract which may be archived in accordance with the provisions of the Commercial Code relating to the duration of the retention of books and documents created in the course of commercial activities and of the Consumer Code relating to the retention of contracts concluded by electronic means

Cookies: how do we use them?

6.1 What is a cookie?

A cookie is a text file that may be stored in a terminal when consulting an online service with a browser. During its period of validity, a cookie file enables its issuer to recognise the terminal concerned each time this terminal accesses digital content containing cookies from the same issuer.

6.2 What is the purpose of the cookies issued on our Site?
